Get locked up for 'unlocking'?

As of Saturday, it is illegal to unlock a phone or tablet without permission from your carrier. 

According to The Verge, the Digital Millenium Copyright Act now states that it is illegal to unlock phones and tablets without permission from your carrier. Unlocking makes your phone capable of being used with different service providers, which is helpful if switching carriers.

However, it is still legal to purchase already unlocked phones from carriers, like Verizon's iPhone 5 and the Nexus 4.

eWeek explains that this process was exempted from the act for six years, until the Librarian of Congress determined it should be applied.

Even with the new law in place, some phone carriers are cooperative with unlocking phones with authorization, such as T-Mobile and AT&T.

 

Is the new addition to the Digital Millenium Copyright Act fair to phone owners?

Should it be the sole responsibility of the Librarian of Congress to make this decision?
